In order to exercise the right of self-immunity even if one is unable to make decisions, powers of attorney are the legal remedy of choice.



General power of attorney

A general power of attorney is particularly suitable as a precautionary measure. It ensures that the authorized representative can also have bank accounts in an emergency, for example, and in particular can regulate the financial matters associated with the emergency. A general power of attorney also enables the authorized representative to dispose of the assets and also to settle accounts with insurance companies and aid agencies.

A power of attorney gives the proxy, who enjoys the trust of the proxy, a right to make decisions in all personal matters arising from emergencies to the extent that the proxy is entitled to do so if he or she is able to make decisions and act. Such a regulation is particularly necessary if the elected confidant is not married to the proxy or has a close relationship. It also makes sense if a certain relative is to be entrusted solely and exclusively with this task. For the rest, it generally makes it easier for the confidant to deal with the persons treating and caring for the person concerned.

Just like the (general) power of attorney, the scope of the power of attorney enables the authorized person to act immediately - which can be very important, especially in an emergency.
